Terms of Service

1. Agreement to Terms

By accessing or using the Flagpool platform, website (flagpool.io), dashboard application, SDKs, APIs, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Flagpool is a feature flag management platform that allows you to control the release of features in your applications. The Service includes a web-based dashboard for managing feature flags, targeting rules, and environments; client SDKs for evaluating flags in your applications; a CDN for delivering flag configurations globally; and optional analytics for tracking flag evaluations.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

You must be at least 16 years old to create an account. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Subscriptions & Billing

Flagpool offers a free tier and paid subscription plans. Details of features and limits for each plan are described on our Pricing page.

Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. By subscribing to a paid plan, you authorize us to charge the applicable fees to your payment method.

You may cancel your subscription at any time. Upon cancellation, your account will revert to the free tier at the end of the current billing period. No refunds are provided for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service (except as permitted by applicable open-source licenses for our SDKs)
• Use the Service to store or transmit malicious code
• Resell or redistribute the Service without our prior written consent
• Exceed the usage limits of your subscription plan through automated or abusive means

6. Your Data

You retain all rights to the data you store in the Service, including feature flag configurations, targeting rules, and target list contents. We claim no ownership over your data.

You grant us a limited license to host, store, and process your data solely to provide the Service. This includes delivering flag configurations via our CDN and processing analytics data when enabled.

You are responsible for ensuring that any data you store in Flagpool (including target lists containing user identifiers) complies with applicable data protection laws and that you have obtained any necessary consents from your end users.

7. SDKs & Open Source

Flagpool SDKs are provided under open-source licenses as specified in their respective repositories. Your use of the SDKs is subject to both these Terms (for the Service they connect to) and the applicable open-source license (for the SDK code itself).

8. API Keys & Security

You are responsible for safeguarding your API keys, decryption keys, and any other credentials associated with your account. Do not share or expose these credentials in public repositories, client-side code (beyond the publishable API key intended for client use), or insecure environments.

You must notify us immediately at security@flagpool.io if you suspect unauthorized access to your account or credentials.

9. Service Availability

We strive to maintain high availability of the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Flag configurations are delivered via CDN as static files and are cached locally by our SDKs. This means your applications can continue to evaluate flags using cached configurations even during temporary service disruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Flagpool shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that it will be uninterrupted, secure, or error-free.

12. Termination

You may terminate your account at any time by contacting us or through the dashboard settings. We may suspend or terminate your account if you violate these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account termination, unless retention is required by law.

13. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by email or by posting a notice on our website. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Flagpool operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
